IMPORTANT : THIS IS A BINDING LEGAL AGREEMENT (this "Agreement"). PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS PLATFORM. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
By accessing, browsing and using Louis Hotels Group websites or internet sites or any of our mobile applications through whatever online platform (hereafter collectively referred to as the Platform) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to these Terms of Use and the General Booking Terms (including the Privacy Notice). Louis Hotels Group entities and affiliates are defined in the Privacy Notice.
The pages of the Platform, the content and infrastructure of the Platform, and any online service (including the facilitation of payment service) provided by Louis Hotels through any of its website are owned, operated and provided by Louis Hotels Public Company Limited or its subsidiaries or affiliates and are provided for your personal, non-commercial use only, subject to these Terms of Use set out below.
Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Platform, including contests, promotions, or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Platform or for any service offered on or through the Platform, the latter terms shall control with respect to your use of that portion of the Platform or the specific service.
These Terms of Use may be amended, changed, or modified in any way at any time without notice and such changes will become effective immediately (unless otherwise indicated). Therefore, please check these terms periodically for changes. Your continued use of the site following the posting of changes to these terms and conditions will mean you accept those changes.
By using, viewing, transmitting, caching, storing and/or otherwise utilising an internet site or the Platform, the services or functions offered in or by the internet site or a mobile application and/or the contents of the Platform in any way, you agree to each and all of the terms and conditions set forth below, and waive any right to claim ambiguity or error in this Agreement. You shall comply with all applicable laws, statutes, ordinances, and regulations regarding your use of the Platform and your solicitation of offers to purchase and/or sell products and/or services.
All services noted on the Platform likely to be created or uploaded in the future are subject to these terms and conditions of use whether visiting, viewing and or using any services contained herein, presupposes the acceptance and submission to these Terms of Use.
The documents, data, information and other materials provided on any Louis Platform are provided by Louis Hotels Public Company Limited ., a company within the Louis Hotels Group, exclusively for non-commercial use and only for individual use by prospective and confirmed Louis Hotels guests.
Warning Notice: By using the Platform or any internet site, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send to the Platform may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
Agreement for Use of the Platform
A User warrants that he/she possesses the legal authority to enter into any agreement and to use the Platform. If you use one of the links on the Platform to visit third party websites or internet applications, then please note that your viewing of these sites or applications and any purchases made through them will be and are subject to separate terms and conditions.
Specific terms for Mobile Application (Mobile App)
By using the Mobile App, in addition to these Terms of Use, you agree to the specific terms and conditions governing use of the Mobile App as set forth in this Mobile App License Agreement Section, (the EULA).
Louis Hotels grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Louis Hotels Mobile App for your personal and internal business purposes strictly in accordance with this Agreement. You are responsible for complying with the updated terms posted online at Louis Hotels Platform website even if these updated terms appear online at Louis Hotels website before being posted on the Mobile App. Your continued use of the Mobile App after Louis Hotels publishes notice of changes to the Terms of Use indicates your consent to the updated terms.
Use of Mobile App : Louis Hotels Mobile App which allows a User to access the Louis Hotels Platform an internet-delivered service (subscription service) from the users’ mobile device; provided the mobile device can support the service.
You agree that you will not use or encourage others to use the Mobile App in a way that could harm or impair others’ use of the Mobile App and your use of the subscription service offered under the Platform and the Mobile App is governed by these Terms of Use. You also agree not to violate the usage limits or controls set forth by: (a) the App Store Terms of Service, for iOS users accessing the Mobile App on an Apple product, or (b) Google Play Terms of Service for Android users accessing the Mobile App on an Android product.
Louis Hotels may deploy changes, updates, or enhancements to the Mobile App at any time. Louis Hotels may provide maintenance and support for the Mobile App, but has no obligation whatsoever to furnish such services to you and may terminate such services at any time without notice. You acknowledge that neither Apple (for iOS Mobile App) nor Google (for Android Mobile App) has an obligation to furnish any maintenance or support services in connection with the Mobile App.
Consent to Electronic Communications and Solicitation: by downloading the Mobile App, you authorise Louis Hotels Group to send you (including via email and push notifications) information regarding the service you have subscribed and the Mobile App, such as: (a) notices about your use of the Mobile App, including notices of violations of use; (b) updates to the subscription service and Mobile App and new features or products; and (c) promotional information and materials regarding Louis Hotels offers and services. You can review your account notification settings and adjust Your messaging preferences, including opting-in to additional messages or unsubscribing to certain messaging through the “Push Notifications” section of the Mobile App settings.
In order to operate and provide the services through the Mobile App, Louis Hotels may collect certain information about you, including technical and telemetry data related to your use of the Mobile App. We use third party service providers to help us collect and analyse this data, including Google Analytics . Louis Hotels uses and protects that information in accordance with its Privacy Notice. This Agreement is executed between you and Louis Hotels and not between you and any other party, including Apple for iOS users and Google for Android users. You agree that any claims brought by you arising out of this Agreement or your use of the Mobile App will not be made against Apple or Google, as applicable. Louis Hotels is not responsible for any applicable third-party agreement between you and your any third-party, including your wireless provider.
General Online Services and use of the Platform
Through its Platform, Louis Hotels Group provides a User with access to a variety of resources, including information about its business and the services offered at its Hotels or its restaurants including providing the opportunity to make online reservations at its facilities (if available). All services, including any updates, enhancements, new features, and/or the addition of any products or services are subject to these Terms of Use, the General Booking Terms, and the Privacy Notice .
By using or utilising the Platform (e.g. by making a reservation), you enter into a direct (legally binding) contractual relationship with the Hotel with which you make a reservation or purchase a service (as applicable).
Hotel Reservations
Any reservations made through the Platform is subject to availability, any special conditions noted at the time of reservation but also as per Louis Hotels Group General Booking Terms and subject to the law and exclusive jurisdiction of the courts of the country in which the Hotel that a reservation is made is located.
Restaurant Reservations
Any reservations made through the Platform is subject to special terms noted at the time of booking or at such restaurants individual website a nd subject to the law and exclusive jurisdiction of the courts of the country in which the Hotel is located.
Personal/Non- Commercial Use
Unless otherwise specified, as noted content and information displayed on the Platform are for the individual user personal and non-commercial use ONLY. You may not modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from the website. You only have a limited, non-transferrable, recoverable license to view the content displayed on the Platform and the materials display solely for personal use, subject to the restrictions set in these Terms of Use.
Commercial use of this website is strictly prohibited unless otherwise authorised by Louis Hotels Group.
The user agrees that the material which is downloaded or otherwise is accessed through the use of the Platform is received entirely under his or her own responsibility and he or she will be entirely responsible for any resulting damage to the software or to the computer systems and/or for any resulting loss of data.
No guarantee.
Louis Hotels Group does not guarantee that the Online Services or Platform or the servers from which any application or internet site is placed at the disposal of users is invulnerable to all security breaches. To this effect, Louis Hotel Groups makes no warranty, guarantee or representation that use of the Online Services or Platform is protected from viruses, security threats or other vulnerabilities.
Not unlawful use
As a condition of your use of the Platform, you will not use the Platform, or any functions provided for convenience (e.g. online reservations) for any purpose that is unlawful or prohibited by these Terms of Use and notices. You may not use the Platform in any manner that could damage, disable, overburden, or impair any Louis Hotels Group server/s, or the network(s) connected to any Louis Hotels Group server, or interfere with any other party's use and enjoyment of the Platform.
You may not attempt to gain unauthorised access to any hardware or software systems or any service through the Platform, other accounts, computer systems or networks connected to any Louis Hotels Group server/s or through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Platform. You shall not try or attempt or in any way post, transmit or disseminate any information on or via the Platform which is or may be harmful, obscene, defamatory or otherwise illegal or to upload or transfer any data, program or device that may corrupt or cause any virus to the website in any way.
The user shall hold the Louis Hotels Group member which may be affected, harmless from and against any and all losses, damages, costs and expenses (including legal fees) resulting from any claim or actions brought against any Louis Hotels Group member or arising as a result of any breach or violation of these Terms of Use by the user. Louis Hotels Group has the right, at its own expense, to assume exclusive defence against any claim and all negotiations for settlement and the user agrees to cooperate with Louis Hotels Group in the defence of any such claim, at the request of Louis Hotels Group.
Content and Information posted on Social Media or the Platform
Louis Hotels Group members or its respective suppliers, affiliates or employees make no representations about the suitability of the information contained in the website and related graphics, images, videos, audio, texts, data published for any purpose. All such information and material on the website are provided “AS IS” without warranty of any kind. Louis Hotels Group members and/or its respective suppliers hereby disclaim all warranties and conditions with regard to such information including all warranties and conditions of merchantability whether express, implied, or statutory, fitness for a particular purpose, title, and non- infringement.
Louis Hotels Group makes every effort to ensure that the information contained on the Platform is accurate to the extent that is able to be verified by Louis Hotels Group. Therefore, Louis Hotels may not be in a position to guarantee the accuracy of all information. Louis Hotels Group welcomes your feedback if you identify any inaccuracy. No Warranty
Louis Hotels Group does not warrant the accuracy, adequacy or completeness of the information and the material contained in the website and any information displayed is subject to alterations without previous notice. The tools, documents and related graphics, video, data, audio published on the Platform could include technical inaccuracies or typographical errors. Changes are periodically added to the information herein. Louis Hotels may make improvements and/or changes to the contents of the function or internet site of the Platform Louis Hotels does not guarantee an uninterrupted or fault free operation of the Platform.
Limitation Liability
LOUIS HOTELS GROUP EXPRESSLY DISCLAIMS ANY LIABILITY FOR DIRECT OR INDIRECT LOSS OR DAMAGE WHICH MIGHT RESULT FROM THE USE OR INCOMPETENCE IN USE OF THE PLATFORM OR FROM ERRORS, OMISSIONS, MISTAKES, TYPING MISTAKES OR OTHERWISE OR SYSTEM FAILURE DUE TO FORCE MAJEURE OR FOR WHATEVER OTHER REASON.
Collection and Processing of Personal Data
Louis Hotels may collect personal data from users at different points (only subject to consent) on the website and does not provide such information to third parties unless as specified in the Privacy Notice. Users acknowledge that when reading pages under the website, non-personal information may automatically be collected in the form of Cookies to recognise users who often visit an internet site or the Platform. Please refer to our Cookie Notice for further details.
Codes and Passwords
In case that the Platform may provide as user with the ability to use usernames, passwords, or other codes or devices to gain access to certain sections of the website , the user is entirely responsible for maintaining the confidentiality of his/her access codes and for all activities that occur under his/her account. We reserve the right to immediately terminate the user’s account in our sole discretion and without prior notice to you, for example, if you violate any part of these Terms of Use.
You agree to inform us at info@louishotels.com immediately of any unauthorised use of your account or password, or any other breach of security. You may be held liable for losses incurred by Louis Hotels or any other user of or visitor to the Platform due to someone else using your code, password or account as a result of your failing to keep your account information secure and confidential.
Third Parties Linked Websites
The Platform may contain links to third-party websites or services that are not owned or controlled by Louis Hotels Group. Louis Hotels Group has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Louis Hotels Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available or through any such websites or services.
Louis Hotels Group shall not be liable in respect of the site of third persons to which there is access through the Platform and does not approve nor accepts nor adopts nor endorses the content of any such internet site or application. A link to another site or service is not an endorsement of that site or service. Any use you make of the information provided on the Platform, or any site or service linked to by the Platform not operated by Louis Hotels Group is at user’s own risk. You will need to make your own independent judgment regarding your interaction with such linked internet sites or online services.
Louis Hotels Group Public Blogs/ Public Communications / Social Media Use
Blog or forum means a chat area, message board, or e-mail function offered as part of the Platform through or facilitate from its functions e.g. Mobile App). If you participate in a Blog within the Platform of Social Media, if applicable, you must not: (i) defame, abuse, harass or threaten others; (ii) make any bigoted, hateful or racially offensive statements; (iii) advocate illegal activity or discuss illegal activities with the intent to commit them; (iv) post or distribute any material that infringes and/or violates any right of a third party or any law; (v) post or distribute any vulgar, obscene, discourteous or indecent language or images; (vi) use the Platform for commercial purposes of any kind other than to facilitate a transaction on the Platform; (vii) post or distribute any software or other materials which contain a virus or other harmful component; or (viii) post material or make statements that do not generally pertain to the designated topic or theme of any chat room or bulletin board. You shall remain solely responsible for the content of your messages and shall indemnify and hold the Indemnified Parties harmless for the content of such messages. We reserve the right to remove or edit content from any Forum at any time and for any reason.
By uploading materials to any Blog or Social Media Account of Louis Hotels Group or making reference to Louis Hotels or submitting any materials to us, you automatically grant (or warrant that the owner of such materials expressly granted) us a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, publicly perform and display, create derivative works from and distribute such materials or incorporate such materials into any form, medium, or technology now known or later developed throughout the world.
We cannot be responsible for the content or accuracy of any information, and we shall not be responsible for any trading or investment decisions made based on information made by third parties.
Trademarks and Intellectual Property Rights
The copyrights and the Intellectual Property rights of the Platform and the screens displaying any page except where otherwise expressly provided, that is, rights regarding the text, graphics, logos, data, pictures, material and information contained in this website, are solely, exclusively and absolutely owned by Louis Hotels or authorised to be used by Louis Hotels. Any copy, saving, modification, publication, distribution, transmission, broadcast, display all or part of the Platform or the information or material contained in it or the reproduction or embodiment on paper or electronic means or in any other form for any purpose is strictly prohibited unless authorised by the respective owner.
Jurisdiction
The use of the Platform is subject to the laws of the Republic of Cyprus and should any term in these Terms of Use be considered invalid from any supervisory court, the invalidity of this term will not impair the validity, legality and enforceability of the other terms which will continue to be valid and enforceable. You shall remain bound by all other provisions hereof and, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these Terms of Use.
The Platform is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation. The products and/or services described in and available through the Product may not be available in your country. We make no representation that the services or products offered in the Platform are appropriate or available for use in any particular location.
The original English version of these Terms of Use may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these Terms of Use or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive.
Electronic Communication
There is no guarantee or confidentiality of any communication or information transmitted on or through the functions of the Platform or of any other website or application linked to the Platform. Louis Hotels Group will not be liable for the privacy of any information or communication or any other content a user elects to transmit over social media networks (e.g. Facebook, Instagram etc.), accessed by the user through the Platform or otherwise connected to the use of the Platform, or its functions and applications, through internet.
No Agency
You and Louis Hotels are independent contractors, and no agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement.
